In the period of August 2021, an Assamese named Vinodbhai Ranabhai Babaria took a loan of Rs. five lakh from the Credit Co-operative Society Mandali. After that, the accused could not pay the loan installments regularly. As a result of the remaining dues, the accused Vinodbhai gave a cheque of Rs. 4,67,560 to the complainant Mandali.
The complainant presented this check in the bank and a return was made. Therefore, the complainant filed a complaint against the accused under the Negotiable Instruments Act. During the hearing of the case, the learned Court, after considering the oral and documentary evidence on behalf of the accused as well as the arguments of both the parties, noted that the complainant had failed to prove the legal debt. Therefore, the court ordered the acquittal of the accused Vinodbhai Ranabhai Babaria.
In this case, young advocates from Rajkot, Ajay Davda, Bhavisha Pandit, Meet Somaiya, Yash Cholera, Rohini Vyas, etc., appeared for the accused.
